Waiverable Offenses

Certain traffic violations and criminal offenses can be waivered - that is you can admit guilt and pay your fines and court costs by mail without having to come to court. Other violations REQUIRE a court appearance under the law.   Below you will find a list of the mandatory appearances as well as the waiverable ones.

The date on the ticket is the LAST day you will have to plead not guilty, waiver the charge, or appear in court.  If you plead NOT GUILTY, a future court date will be assigned.

Mandatory Court Appearances

If you have been cited for one of the following citation you are REQUIRED to appear in court on the date listed at the bottom of your citation:

  1. Operating a motor vehicle under the influence of alcohol or drugs or a breath alcohol content of .08% or more.
  2. Leaving the scene of an accident/Hit-skip.
  3. No operator's license; not licensed to drive; license expired OVER six (6) months.
  4. Driving under ANY suspension or revocation.
  5. Passing a stopped school bus.
  6. Wrongful entrustment/allowing a person under suspension to operate your motor vehicle.
  7. A third (3rd) moving violation within a one-year period.

All fines and costs are due on the date you appear in court.

ALL THE ABOVE LISTED VIOLATIONS REQUIRE PROOF OF INSURANCE FOR THE DATE OF THE CITATION. IF YOUR TICKET IS MARKED "FR NOT SHOWN" YOU MUST BRING YOUR PROOF TO COURT. DO NOT BRING INVOICES OR APPLICATIONS. YOU NEED AN INSURANCE CARD WITH EFFECTIVE DATES FOR THE CAR LISTED IN THE CITATION, OR A LETTER FROM YOUR AGENT.

FAILURE TO PROVE INSURANCE WILL RESULT IN A SUSPENSION IMPOSED BY THE OHIO BUREAU OF MOTOR VEHICLES--NOT THE COURT-- AND YOUR LICENSE WILL BE SUSPENDED FOR A MINIMUM OF 90 DAYS.

Waiverable Citations

The following traffic tickets may be waivered by paying the amounts show next to the citation.  Waivers must be paid in full - NO PARTIAL PAYMENTS!

IMPORTANT INFORMATION

If you received more than one violation on the face of the traffic ticket, add all the charges from the above chart and SUBTRACT $70.00 for each violation over one: Exceptions: Subtract only $41.00 for a seat belt violation when issued with another violation. SEE EXAMPLES BELOW

ALL VIOLATIONS REQUIRE PROOF OF INSURANCE DIRECTLY TO THE COURT IF THE BOX ON YOUR CITATION IS MARKED "FR NOT SHOWN" OR IF THE BOXES ARE NOT MARKED AT ALL--YOU MUST INCLUDE PROOF OF YOUR INSURANCE WITH YOUR PAYMENT (COPY OF YOUR CARD SHOWING EFFECTIVE DATES AND CAR INSURED)

You may waive the above citations by paying the computed amount by several methods:

  1. You may pay at the police department violations bureau located at the north entrance to the city hall building WHEN THE COURT IS NOT OPEN. You must have exact change if you pay in cash at the violations bureau, no change available.
  2. By mail to: Cleveland Heights Municipal Court 40 Severance Circle Cleveland Heights, OH 44118
  3. You may drop your payment in the PAYMENT Boxes at the front of city hall. PLEASE use the envelope marked "COURT PAYMENT"  which is  available at the box.

Checks must have current address and phone number listed. Please write ticket number on memo line for proper credit.
